Custody and Guardianship: What Is the Difference?

Parents often use “custody” and “guardianship” to mean the same thing, but UAE law distinguishes between them.

Custody generally relates to the child’s daily life. It concerns where the child lives, who provides routine care and how the child’s immediate physical, educational and emotional needs are met.

Guardianship can include wider legal and financial responsibilities. Depending on the applicable law and court order, it may relate to matters such as official documentation, financial affairs, travel and other significant decisions.

A parent may therefore have custody while certain guardianship responsibilities remain with the other parent. The exact division of responsibility should be assessed against the applicable law and any orders issued by the court.

Can a Father Obtain Child Custody in Dubai?

Yes. A father may apply for custody when he believes that living with him would better protect the child’s welfare or when the existing custodian no longer satisfies the necessary legal conditions.

The outcome is not automatic. The court may consider the father’s relationship with the child, caregiving ability, home environment, work arrangements and capacity to meet the child’s educational, emotional and physical needs.

It is also important to distinguish a father’s guardianship responsibilities from physical custody. Having guardianship does not necessarily mean that the child will live with the father.

Can a Child Choose Which Parent to Live With?

Unfortunately, my experience with this service has been very disappointing — particularly for foreign clients. There appears to be little genuine interest in customer satisfaction once the contract is signed. Prior to signing, several promises were made which later turned out to be inaccurate or misleading. That initial phase seemed to be the only time I received proper attention. After the agreement was finalized, any further communication or support seemed contingent on paying additional fees. For instance, I was informed that a Power of Attorney (POA) was essential to proceed, which led me to incur a cost of 800+ AED. Later, it became clear that the POA was not required after all. Despite this, there was no accountability or willingness to resolve the issue. Communication has also been extremely slow and disorganized. Without regular follow-up from my side, the case would have been entirely neglected. There was no clear strategy or dedicated effort — only sporadic and uncoordinated actions that lacked any real potential for success. In summary, I strongly advise looking for alternative providers — particularly if your case involves working with Mr. Saad.

Basit (Legal Assistant) has proven to be an asset to the firm and was pivotal to the success of my eviction case. Overtime, what I believed would be a simple case became more complex. His dedication to ensure I received the best service and remained well informed (even during his vacation) made an overall stressful experience manageable. The effort and service received means that I would work with him again, in turn the firm. Also, another highlight identified was that the written memos delivered to the courts by Moaz and Hassan (both Lawyers) during my eviction case were succint and showed a strong knowledge of Dubai law. I was pleased as I relied heavily on the approach to the courts being appropriate because as a native English UAE resident I do not speak or understand Arabic.

After many months, today we had the best news ever and we found out that our case is finally closed. I contacted Mussab Ali Al Naqbi lawyers a few months back as my husband had a criminal case. Their service has been impeccable from start to finish. As soon as I sent them my enquiry I received a call from Mr Saad, who was very reassuring and very detailed in what to expect and how to move forward. We were invited to their office where we met with Mr Khalifa, who put us at ease and talked to us to make sure we understood everything and that we now had a plan in place, so we didn't need to worry. We then started the hearings and the proceeding. Every time we were contacted beforehand to make sure we were ready, we were accompanied by Mr Musaab Ali inside the courtroom who represented us in a very professional way and also explained to us what was happening after every single hearing. Then Mr Khalifa accompanied me throughout all the bureaucracy, the various offices in the courthouse, the public prosecution and all the other processes. He was always available and ready to answer my million questions. He kept updating me and he lifted up my spirit when I was really stressed and really worried. It felt like I was with my family. Honestly, all the staff was amazing. After losing the first appeal, many lawyers told me I have very less chance of getting the judgement in my favour. Alhumdulilah, I was introduced to Mr.Ibrahim Khalil, and during the meeting he assured me that, this is not the the time to give up.
