Arbitration is a procedure in which a dispute is submitted, by agreement of the parties, to one or more arbitration lawyers who make a binding decision on the dispute. It is the most traditional form of private dispute resolution. FORMS OF ARBITRATION:

The following are the forms of Arbitration:

High-Low Arbitration:

In high-low arbitration, the parties (not the arbitrator) set a maximum and minimum award threshold. These limits might be known by the arbitration lawyer, but the parties usually will not reveal their agreement to the arbitrator to take out some extra insurance that the final arbitration award will be a fair one.

Baseball Arbitration:

In baseball arbitration, each side submits a figure or proposed remedy, and the arbitrator is required to select one offer or the other. The arbitration lawyer in UAE cannot formulate a compromise or choose the midpoint between the two.

Non-Binding Arbitration:

It is a proceeding, less formal than a jury trial, where both sides present their evidence to a neutral arbitrator, or an arbitration panel, who then decides the issues at hand in the case. The primary advantage of non-binding arbitration is that it offers the parties an opportunity to settle their dispute outside the courtroom without being bound by the arbitrator’s decision. A non-binding arbitration clause is a provision in a contract for arbitration. This provision states that any issues with the contract must be carried out through arbitration, but the non-binding aspect means that the parties are not bound by the decision of the arbitrator once the process is complete.

Mandatory Arbitration:

It is a private proceeding to settle disagreements between two parties. Parties to a contract agree to have their case reviewed by a third party called an arbitration lawyer and to be bound by the arbitrator’s decision. Mandatory binding arbitration often requires the parties to waive specific rights. Specifically, the provision in a contract removes or limits a party from suing if they feel wronged—they must go to arbitration instead. It also takes away their right to appeal any decision. By its binding nature, the proceeding means the arbiter’s judgment is a final one.

The Federal Law No. 6/2018 on Arbitration Law is the first law on arbitration by the UAE Government. The new law, Federal Law No. (15) of 2023 (the “Amendment Law “), introduces some significant changes to the arbitration regime in the UAE, aiming to enhance its efficiency, flexibility, and attractiveness for domestic and international parties. The Arbitral institutions in the United Arab Emirates are as follows; 

  • ADCCAC is also known as Abu Dhabi Conciliation and Arbitration Centre 
  • DIAS is also known as the Dubai International Arbitration Centre 
  • (DIFC-LCIA) London Court of International Arbitration Centre
  • Sharjah International Commercial Arbitration Centre 
  • Ras Al-Khaimah Centre for Reconciliation and Commercial Arbitration

Advantages

The following are the advantages of an Arbitration Lawyer:

  • The proceedings are confidential (unless the parties agree otherwise).
  • In technical subject matters, Arbitration lawyer with the requisite expertise can be appointed to deal with those disputes.
  • Local court litigation is always in Arabic, whereas Arbitrations can be conducted in English, or in any other language agreed to by the parties.
  • Oral evidence is permitted in arbitration, whereas only written submissions are generally permitted in the courts.
  • There are limited avenues for appealing arbitral awards and the merits of a decision cannot be challenged.
  • Both sides will have to agree on an arbitrator; this is a great opportunity to appoint somebody who is extremely familiar with the area in dispute. This may well be a lot more advantageous than appointing a judge who, although legally sound, may not be able to relate to that particular industry’s normal practices.

Disadvantages

Some disadvantages of arbitration include:

  • Arbitral proceedings are generally more costly, taking into account of the tribunal and administrative fees.
  • Arbitration awards must be ratified by the courts to be enforceable. This can cause delays and extra costs in the enforcement of an award, although the position has improved with the introduction of the Arbitration Law.
  • For most, having a jury is an important right that helps prevent biases and unfairness. Arbitration eliminates juries entirely, leaving matters in the hands of a single arbitration lawyer, who acts as both judge and jury.
  • Arbitration hearings are generally held in private, which may be a positive to many. However, it is possible that this lack of transparency makes the process more likely to be biased, which may be problematic because arbitration decisions are also infrequently reviewed by the courts.
